Legal Insurrection: Big Oil triumphs over the Big Apple, as judge dismisses “climate change” lawsuit.
What is even better than one legal victory over green justice warriors targeting Big Oil over fallacious charges of “climate change” environmental impacts?
Two!
A U.S. judge on Thursday dismissed a lawsuit by New York City seeking to hold major oil companies liable for climate change caused by carbon emissions from burning fossil fuels.
In dismissing the city’s claims against Chevron Corp , BP Plc , ConocoPhillips , Exxon Mobil Corp and Royal Dutch Shell Plc , U.S. District Judge John Keenan in Manhattan said climate change must be addressed through federal regulation and foreign policy.
“Climate change is a fact of life, as is not contested by Defendants,” he wrote. “But the serious problems caused thereby are not for the judiciary to ameliorate. Global warming and solutions thereto must be addressed by the two other branches of government.”
The petroleum companies hailed the decision, which is a victory of common sense over #FakeScience hysteria. MORE
It’s too bad the judge dismissed the suit.
It would have been more fun to have the oil companies quit selling their products in and around NY as part of their “global warming mitigation plan”.
I don’t think that’s a good judgement and here’s why:
That is not a judgement that will stand. Either they have standing to sue or they don’t. To have standing to sue they have to be a party that was harmed. They have to prove a harm has been done to them.
The judges issuing these judgements aren’t doing right. It isn’t their call to say something is too politically hot for their courtroom.
The suits should have been thrown out because no one has standing to sue as no one has proof of actual harm.
I don’t see it as a standing issue, I see it as a subject matter jurisdiction question. If the EPA has the authority to do this then the courts are preempted from “legislating” from the bench.
I wonder what the Second Circus will say about this when Red diBlasio appeals?
“Climate change is a fact of life, as is not contested by Defendants,” … which gives the environuts more ammo!
Sure hope all those greedy plaintiffs and their lawyers lost a lot of money on this shakedown.
It has been well documented that most of the world’s pollution comes from Africa & Asia (aka shitholes) so, good.
The judge should have levied fines for court costs and frivolous suit.
