President Trump has selected federal appeals court Judge Neil Gorsuch to fill a Supreme Court seat that has sat vacant for nearly a year, setting up a blockbuster confirmation hearing that could put the new White House’s domestic political agenda on trial in the U.S. Senate.

The selection fulfills an early campaign promise by Trump to nominate a solidly conservative judge with a record of strictly interpreting the U.S. Constitution. Gorsuch, 49, sailed through an earlier confirmation process for a spot on the federal appeals court in Denver.

Only weeks after his nomination in 2006, the Senate confirmed him by voice vote. The American Bar Association rated him as “unanimously well qualified” at the time.

SCOTUSblog, the leading Supreme Court blog, described some of Gorsuch’s parallels to Scalia as “eerie.”

“He is an ardent textualist (like Scalia); he believes criminal laws should be clear and interpreted in favor of defendants even if that hurts government prosecutions (like Scalia); he is skeptical of efforts to purge religious expression from public spaces (like Scalia); he is highly dubious of legislative history (like Scalia); and he is less than enamored of the dormant commerce clause (like Scalia),” the blog wrote.

Among other rulings that came to national attention, Gorsuch sided in favor of “religious freedom” claims made by the Little Sisters of the Poor and the owners of the craft company Hobby Lobby, who challenged language in the Affordable Care Act that required them to pay for contraceptive coverage for employees. The Supreme Court backed those Hobby Lobby challengers, in a divided vote, in 2014.

In a lecture to the conservative Federalist Society in Washington more than three years ago, Gorsuch elicited laughter from the audience as he quoted from the 1853 Charles Dickens novel Bleak House, referenced the work of the late novelist David Foster Wallace, and discussed irony and the law.

Off the bench, Gorsuch in 2006 published a book called The Future of Assisted Suicide and Euthanasia, criticizing the practice and defending the “intrinsic value” of human life. He also contributed to The Law of Judicial Precedent last year.

When he agreed to deliver a major lecture at Case Western University School of Law early last year, Neil Gorsuch felt the time was ripe to urge reform of “the maddening maze of our civil justice system — its exuberant procedures that price so many out of court and force those in it to wade wearily through years and fortunes to win a judgment.”

But then Supreme Court Justice Antonin Scalia died unexpectedly — Gorsuch, who sits on the U.S. Court of Appeals for the 10th Circuit in Denver, learned of it while contemplating the next field of moguls on a downhill ski run — and he switched topics.

Here are a few choice excerpts from “Of Lions and Bears, Judges and Legislators, and the Legacy of Justice Scalia” that shed light on Gorsuch’s (and Scalia’s) judicial philosophy:

“Judges should… strive (if humanly and so imperfectly) to apply the law as it is, focusing backward, not forward, and looking to text, structure, and history to decide what a reasonable reader at the time of the events in question would have understood the law to be — not to decide cases based on their own moral convictions or the policy consequences they believe might serve society best.”

“Judges should be in the business of declaring what the law is using the traditional tools of interpretation, rather than pronouncing the law as they might wish it to be in light of their own political views.”

“Throughout my decade on the bench, I have watched my colleagues strive day in and day out to do just as Socrates said we should — to hear courteously, answer wisely, consider soberly, and decide impartially.”

Judges should “regularly issue judgments with which they disagree as a matter of policy — all because they think that’s what the law fairly demands.”

“Though the critics are loud and the temptations to join them may be many, mark me down too as a believer that the traditional account of the judicial role Justice Scalia defended will endure.”

  1. I think this is a great pick since they unanimously voted for him before–I truly think they are going to double down on Jeff Sessions (my Senator) because he really scares them personally. That is my opinion!

  7. I heard this name floated several days ago, and the feeling was that Gorsuch would be confirmed fairly easily. Most Democrat senators realize that any Supreme Court nominee will be philosophically closer to Scalia than Ginsberg, and Gorsuch appears to have a sterling record.

    The fight will be over the next Supreme Court nomination – particularly if Ginsberg leaves the court. Gorsuch would be replacing Scalia, but the next nomination could tip the philosophical tenor of the court.

    Of course, there will be many Democrats who will fuss over Gorsuch’s nomination, but these will probably primarily be members of Congress in safe seats – and no one intelligent gives a rat’s ass what Maxine Waters thinks.

    We are now contracting some home remodeling, my Trump sign is in our window, and I always find some way to mention Trump’s name when discussing our projects with the contractors.

    We will not contract with anyone who doesn’t at least have a twinkle in their eye when I mention Trump, because I won’t trust their work ethic.

Back when this campaign started Tucker was a Cruz delegate, Menederman was a Liberal, and there were two people that where carrying the Trump Flag. Before ANYONE. Me and Chief Fillencakes.     Things ANTI-Trump Cruz supporters do not get:
    * Republican candidates are running against the MEDIA. The media will run rough-shod over Cruz like a cement truck. Trump owns the media.
    * Cruz is a POLITICIAN. A Senator no less – like Obama. Trump is a powerful, successful businessman.
    * Trump PROMISES to BUILD a BORDER WALL – UNDER BUDGET with Mexico paying for it. To seriously doubt that is foolish. Trump is in the building business. No other candidate can promise that. If Trump is elected and doesn’t keep his promise – he will go down in history as the biggest fool ever. Trump’s ego will not allow that.

    * Trump’s campaign is SELF-FINANCED – beholden to NOBODY. Cruz is controlled by big donors.
    * Cruz vs. Bush – the GOP will make sure Bush wins and can outspend Cruz. Trump vs. Bush – Trump has the money to beat the GOP machine.

    There’s much more to the advantage of coalescing behind Trump instead of Cruz.
    If I was confident Cruz could make the nominee and win the general election I’d be right there with you with pom poms. BUT… Trump has the name recognition to the general public and has the better shot at winning the White House.

    Republicans have been whining about a THIRD PARTY for decades – you finally got one WITHIN the Republican party with TRUMP.
