Right on Cue – Criminality of Legal Age Sexual Relations Between Teacher and Student Being Challenged in Appellate Court

We covered the case of a 22 year-old assistant track coach who’s out on bail for having sex with a consenting adult. Connecticut law states that consenting adults can go to prison if they have sex in a school setting if one is a school employee and the other a student.

A somewhat similar case is being challenged in Alabama. I say somewhat because the legal age of consent in Alabama is 14, which I think is too young. It makes advocacy for the challenger in the case a lot different than the case in Connecticut.

But the case has merit in that school settings seem to be singled out where other settings should apply but are ignored. And the goal is always equal protection under the law.

If we’re concerned with the dynamic of people in positions of authority having too much influence on impressionable minds, the law should stick to either impressionable minds (people who are not legal adults) or include the clergy, gymnastic coaches, doctors, theĀ  police, hell- LAWYERS.

The idea that only a school teacher is an authoritative figure is strange, and now Charli Jones Parker, who was convicted of having sex with 2 legal age Alabamans(16) is saying it’s unconstitutional.

I understand this doesn’t feel right, and I’m uncomfortable with what she did. But as a matter of law it is interesting.

  1. I understand the emotion. I understand how the teacher is not a sympathetic figure.
    But the law has to make sense when you really look at it, and in my opinion it’s arbitrary.

    Either include all authoritative figures or no one.

    (And 14 for age of consent is a national embarrassment, by the way. What are they thinking? I think the age of consent should be when you wouldn’t eat a Tide pod.)

Assuming this succeeds you know it will only be a matter of time before the law regarding the age of consent in these circles is challenged, meaning that if the age of consent is 14 the law will be changed to allow a 14 year old to have consenual sex with a teacher, The position of “authority” is there for a reason and it is under attack and the sexualizing of the children takes another step forward. When the law discusses people of “authority” they do include cops, clery and the like. The term teachers, when used is usually used as illustrative or for clarity of the type. Generally speaking we only hear of teachers because that’s where most of the hunting takes place.

  3. It may be an interesting legal situation, but isn’t it also interesting that abstaining from unmarried sex is never, ever mentioned as an option? Why isn’t an activity that causes so much harm to people, especially young people, ever discussed? STD’s (possible infertility), sense of shame/guilt, unwanted pregnancy (in an age of condom and birth control pill dispensers in the bathrooms), abortion (obvious problem for the defenseless baby), and it devalues the act of lovemaking to the point that it’s an act equated with clipping one’s toenails. Seems to me, anyway, that you can’t haggle over the “consenting age” of the people involved without also talking about why laws were established for this situation in the first place.

    Next up: Why can’t fathers marry biological daughters or mothers their sons if both are legally adults?

    Probably going to have to impose that chastity, putting the burden back on the female ( Yeah, I know, big assumptions there šŸ™‚ )

    I understand your points and know where you’re coming from, but I’m always more concerned with what the state will jail you for as opposed to what they won’t jail you for.

    If you believe that the state is angling to make sex with people of any age legal by jailing people who are of legal age having sex, I don’t know how to debate that.

    I know there are weirdos who want no age laws regarding sex, they are the fringe.
    I don’t think we’re in danger of allowing that to happen because we think people of legal age should never be jailed for having sex, regardless of the situation.

    I think we can safeguard children without jailing adults when no children were involved in their actions.
