Trump Blocking Critics On Twitter Is Unconstitutional, Judge Rules

DC: A federal judge in New York ruled Wednesday that President Donald Trump cannot lawfully block critics from his personal @realDonaldTrump Twitter account.

U.S. District Court Judge Naomi Reice Buchwald explained Trump’s Twitter account is properly thought of as a “public forum” from which users may not be excluded on the basis of their views.

“We hold that portions of the @realDonaldTrump account — the ‘interactive space’ where Twitter users may directly engage with the content of the President’s tweets — are properly analyzed under the ‘public forum’ doctrines set forth by the Supreme Court, that such space is a designated public forum, and that the blocking of the plaintiffs based on their political speech constitutes viewpoint discrimination that violates the First Amendment,” the decision reads.  more

  5. This is good news. I expect this will open the door to conservatives to stop Twitter from blocking them. I will take time and a couple court victories, but this is OK. Trust the plan.

  6. A private account on a private network…where’s the problem? Will this be “equally” enforced for ALL public officials? What about Twatter’s own ban hammer? Will THEY be forced to allow ALL content too? Looks like the judge just added more lubricant to an already slippery slope.

  7. A judge can’t just make this decision for Trump alone based on the 1A. This decision has to apply to all elected and appointed government officials. Demand every democrat official scrub their block list now too.

  8. Well. I hope conservatives take over a hashtag (preferably one started by a lib who though he was being all social justice-y) IN A BIG WAY and use it to tweet left and right US public officials who cannot block them! (Not tweet harassment, but disagree enthusiastically!

  9. Trump just gives his sign on to a trusted non-government person and just calls him with a message. That person runs the account as Trump wants, blocks nutballs and runs the account as a private person who echoes messages from Trump. No problem, all fixed. Hillary did something similar and got away with it.
