ATF Reversal Could Turn Millions of Gun Owners into Felons

A declaration from the Bureau of Alcohol, Tobacco, Firearms, and Explosives could leave millions of American gun owners in serious legal jeopardy.

In a letter made public on Tuesday, the agency informed a New Hampshire gun company that its AR-15 pistol model equipped with a specialized brace is actually an illegal short-barreled rifle and anyone who owns one could be subject to up to 10 years in prison or $100,000 in fines. Industry insiders put the number of AR-15 pistols equipped with similar specialized braces at about 3 million.

The decision appears to conflict with several similar determinations made by the ATF dating back to 2012, when the agency told Sig Sauer that the braces, designed to strap to a shooter’s forearm instead of being pressed against their shoulder, could be legally combined with guns that have barrels shorter than the 16-inch federal limit for rifles. The new letter calls into question the basic legality of the devices and leaves gun owners in flux just three weeks before the presidential election.

  1. From what I understand, and no one really knows yet, the problem is with that specific pistol brace arrangement. It seems to be intended more for use as a stock than as a forearm brace. Removing it would resolve the problem as near as I can tell, maybe avoiding those braces on a pistol in the first place would be a good idea, they’ve always been questionable and I’ve never seen any real use for them to make the pistol any more usable in the first place (I find they get in the way of their utility, but to each his own).

    In any event, keep your eyes open and watch for any further developments and clarifications if you own one.

    Think again, almost all gun laws are retroactive laws applied to guns that already exist at the time they were instituted (most recent one being the bump stock reclassification as a machine gun making simply possessing one a serious gun crime).

  3. The heart burn the ATF is having over this weapon has nothing to do with the the design of the “Brace” and everything to do with the way they are advertising it. Also, if I’m paying $2800.00 for an aluminum modular framed weapon I would hope the idiots that are manufacturing it would use the same alloy of aluminum so the receivers would plate up the same color.

    Any gun law is an infringement.

    Question: What batshit-crazy law enforcement arm will enforce this nonsense? Even stupid cops understand what self-preservation is and what it will lead to.

    I’m not really concerned, I tell ya.

    Am I and millions of weapons owners whistling past the graveyard on this? Possibly. But it’ll be THEIR graveyard overwhelmingly, not ours.

    Probably more like 10 million, considering the popularity & price of kits you could buy for around $300.00, + LR, at PSA, Midway & other such outfits, prior to this year.
    Don’t forget those weapons built with 80% lowers, either!
    I remember the early AR pistols just had the buffer spring cylinder sticking out before it got commercially popular to hang a sorta butt stock on the end.
    Seems like it’s pretty easy to remove, if that s the issue.
    Put it away safe somewhere though, someday the pendulum may wing back toward sanity.

  7. 1) A simple picture is worth a thousand words and would illustrate exactly what mod/varriant they are talking about but that would give ordinary citizens too clear of a definition and/or counter argument.

    2) This is exactly how they come after you up here in Canuckistan. One tiny mistake, they charge you criminally, and bingo CONFISCATE EVERYTHING.

  8. To my mind the ATF always has been a rogue fed LE agency. Look up Ken Ballew, a ASAF vet who was taking a bath when ATF agents kicked down his door. They did NOT identify themselves, rushed his pregnant wife and shot him in the head when he tried to defend his wife WITH A REPLICA 1847 COLT CAP AND BALL BLACK POWDER REVOLVER (!!!). That left him crippled for life!

  9. This is a fake news article. Screaming idiocy. What made the determination for the ATF that the “Honey Badger” is in fact a short barrelled rifle does not apply to other AR15 type pistols, but is unique to this weapon. The manufacturers should have known that they were crossing a line when the put the extendable stock on it with a shoulder brace. It makes this model a “shoulder fired weapon”, which is the distinguishing difference between this and a pistol. Remove the shoulder brace, and it is a pistol. Simple as that.

  11. Are the atf turds coming after the Mossberg shockwave or the Henry axe shotguns next? My ar in question was registered as a pistol so I’ll put a 16” barrel and A4 stock on it and throw it back in the safe. A pistol caliber carbine was a stupid idea in hindsight.🥴 Wonder what the chumps think of my Echo 2 trigger.
