Judge Reaffirms Constitution Free Zones 100 Miles Inside U.S. Borders

This nonsense makes my blood boil.

District Judge Edward Korman, a US federal judge, has reaffirmed an Obama administration policy granting officials the authority to search Americans’ laptops, citing a controversial premise that makes citizens within 100 miles of the border eligible for a police check.

District Judge Edward Korman made his ruling in New York on Tuesday, more than three years after the American Civil Liberties Union (ACLU) filed suit. The ACLU claimed that – since Americans put so much of their lives on their computers, cell phones, and other devices – border officials should have reasonable suspicion before sifting through someone’s personal files.

Attorneys argued that searches conducted without reasonable suspicion are a violation of the Fourth Amendment, which protects against unreasonable search and seizure.

Not so, according to Judge Korman. In his decision Tuesday he argued that the area 100 miles inland falls under a “border exemption.”

Laptops have only come into widespread use in the twenty-first century. Prior to that time, lawyers, photographers, and scholars managed to travel overseas and consult with clients, take photographs, and conduct scholarly research,” wrote Korman.

  2. This federal government is completely out of control. They cannot annex 100 miles inland from the border. the Constitution gives rights to the American people, so unless this new border region is no longer the United States of America they cannot take away constitutional rights.

    I know it won’t be, but this should be a huge eye-opener for all the Liberals out there. To all those who say that “our rights come from the government.” This is a perfect example of the government taking away our rights.

    It is becoming clearer everyday that national security and the federal government are the biggest dangers to our God given liberty. they do not seems to be doing a whole lot in regards to national security and keeping us safe. Actually it seems to be that they are making us less everyday.

    In my opinion the greatest threat to our national security are open borders and the Muslims who adhere to Sharia law and do not see our laws and constitution as valid. But the federal government opposes any States who try to secure their border. The federal government is actually importing Muslims from third world countries and bringing them to America.

    It’s becoming clear to me that the federal government itself is the greatest threat to America’s national security.

  5. Has anyone else noticed that the federal government has gone into overdrive in attacking the individuals right of privacy in regards to their computers.

    I guess that makes sense, the federal government no doubt see’s instant communication between the people without governmental control as a huge problem for them in concealing an unconstitutional consolidation of power.

    So, let’s recap. CITIZENS within 100 miles of the border are eligible for a police check. But a van full of alleged immigrants are not subject to being checked for their citizenship eligibility!?!

    Gawd, I can’t imagine why any American would be paranoid that the federal government does not have their best interest in mind…

  8. When are we going to realize – the Constitution is only in effect for citizens that respect it. It’s like holding up a crucifix to ward off a vampire – it only works if both sides beleive it.

  12. I’m not the best at geography, but a recent map is telling that Canada’s border with U.S.A. passes through Lake Superior and Lake Huron.

    Lake Michigan is entirely within U.S.A. borders. The color swath they have going around Lake Michigan and into Chicago suggests that Lake Michigan borders Canada and that is simply NOT the case.

If one thinks Arizona’s free zone for illegal alien trafficking is a myth…check out this map! It goes from Mexico’s border to just south of Phoenix…Casa Grande, to be exact.

  16. The actual international border is irrelevant. Here’s relevant part of 8 USC § 1357 – Powers of immigration officers and employees:blockquote>
    a) Powers without warrant
    Any officer or employee of the Service authorized under regulations prescribed by the Attorney General shall have power without warrant—

    (3) within a reasonable distance from any external boundary of the United States, to board and search for aliens any vessel within the territorial waters of the United States and any railway car, aircraft, conveyance, or vehicle, and within a distance of twenty-five miles from any such external boundary to have access to private lands, but not dwellings, for the purpose of patrolling the border to prevent the illegal entry of aliens into the United States;

  17. Toss the Constitution out the open window of sanity and into the wind of chaos. Together with homosexuality and its militant advocacy groups, plus, exchanging freedom for “your right”, security measures will be the straw that either strengthens, or breaks the back of the liberty citizens enjoy.

  18. This might be of interest: This was part of the original INA that went into effect in 1952 during Harry Truman’s regime. The first semi-permanent internal checkpoints (not at border crossings) appeared that year.

    This is not new.

  20. This isn’t a new thing. This has been in place for a while now. You’re just now hearing about it?

    Look into the scene down in the southwest with the unconstitutional “border patrol” stops 40 miles from the border.

    They know well about the 100 mile thing. The youtube videos of people refusing the stops are both entertaining and somewhat disturbing.
