Trump DOJ: No plans to charge Lois Lerner in IRS scandal

FOX: The Trump administration has no plans to charge former IRS official Lois Lerner over her role in the Tea Party targeting scandal, the Justice Department said Friday in response to calls by Republican lawmakers to revisit the case.

In a letter to the lawmakers, the Justice Department said that “reopening the criminal investigation would not be appropriate based on the available evidence.”

This past April, House Ways and Means Committee Chairman Kevin Brady, R-Texas, and Rep. Peter Roskam, R-Ill., had asked Attorney General Jeff Sessions to take a “fresh look” at the case.

Despite numerous hearings and inquiries into the tough treatment of conservative groups by the tax agency during the 2010 and 2012 elections, the Obama Justice Department had announced in 2015 that no one at the IRS would be prosecuted. They said at the time that investigators had “found no evidence that any IRS official acted based on political, discriminatory, corrupt or other inappropriate motives that would support a criminal prosecution.”  MORE

Because maybe if the other IRS creeps [Koskinen, 0bama, etc.] think that she got off,  it’s because she’s snitching and that’s supposed to make them

  1. This is awful. If there was one scandal during the obama regime that was searingly obvious, it was this one. This makes Sessions totally unconvincing when he talks about a return to law and order. Justice delayed is justice denied.

  2. Trump need to enlist the Democrats to help fire Sessions, and then appoint some ass kicker and enlist the Republicans to get him approved with 51 votes. Screw these people. There should be one litmus test. Was she unlawful in her actions? Prosecute the bitch.

  3. Trump needs to hear from people who were hurt by this crooked woman. This is what happens when there is no serious commitment to Conservative values. This is such an obvious example of Obama’s dishonesty and abuse of power, that I can’t imagine why she is going to be allowed to walk free of her crimes. This was the biggest abuse of the IRS in history. What does it take to prosecute this criminal?

    I knew the political elite were not indicted or prosecuted with under the two tiered judicial system.
    Sessions confirmed that the minions who do the corrupt bidding of the elites are exempt from the laws too.

    Equal Justice? Not at the DOJ or the FBI.

  5. This is total bullshit. I was personally targeted by the IRS and her Dept for my contributions to King Street Patriots and True the Vote. This all happened 3 months prior before I ever heard about this. It finally dawned on me after hearing Catherine Englebrect testify before congress in February the following year. The IRS field audit agent was on my door demanding all kinds of things, and for no reason, bc I kept her at bay, while my secretary call the 800 number of the IRS and they did not know why she was there, or why she was demanding all of these specific files and reports. Pure harassment.

  7. This continued failure to prosecute is going to make it very tough to serve on a jury trial in the future. Both my wife and I receive summons just about every year and I have served on more than one jury. It will be difficult to balance between the interest of insuring the law is upheld in my small community and the knowledge that elected officials are repeatedly getting away with very serious crimes without even suffering through investigations. How on earth do I vote guilty when my respect for our justice system is so completely eroded?

  8. OR MAYBE, they’re asking the wrong agency. DOJ reviews the data the FBI provides. Did Comey scrub the evidence? Should Kevin Brady,and Peter Roskam be smart enough to ask the FBI to reopen the investigation. Something is amiss.

  9. Some of Trumps’ best policy position papers during the campaign were attributed in large part to Sessions, were they not? Credit where due, but the Peter Principle is not mocked.

  10. This is very odd. Why announce it it? Do they like seeing us enraged by their criminal behavior? Was Obama the one who gave the order and Lerner spilled the beans with a no charges deal?

Also, I sincerely hope Sessions isn’t thinking he’s going to let 0bama’s admin get away with it because it’s old business and the past is past, of no consequence- because all of 0bama’s and hillary’s doings is why Trump got elected in the first place. If Sessions thinks that 0bama and his henchmen’s crooked acts are no big deal or not interesting enough to pursue, then why is President Trump so busy repealing and ending all of 0bama’s ‘pen and phone’ acts right now? Why is he threatening liberal politicians over sanctuary cities right now? Several states are suing over the clinton foundation. Is Sessions going to supply them with info at all? What a disappointment.

  12. I’m appalled. If she and her boss aren’t prosecuted, there is no longer a democratic form of government here.
    I now really don’t have any faith in our justice system- in how it is administered, or in the department that is charged with that administration. I voted for trump (he no longer gets a capital letter from me), but at present, I am not a fan of his. He campaigned on ‘lock her up,’ put my vote in his pocket and turned his back. Our government, at all levels, seems to be corrupt beyond redemption. Washington DC is the prime example of ‘two-tiers’ of equality. In justice, and in healthcare, where our elected representatives have decided to provide for themselves a better system than the general public is able to have. And we pay for that for them.
    It would be worse with clinton, even worser with bernie, but trump doesn’t impress me. I begin to wonder what Poland might be like.

  14. Trump is juggling a lot of balls right now. He is currently using Pelousy and Schtumor to get at Ryan and McConnell. If he stirs the pot with a public event over Lerner right not his “bigger fish to fry” is lost because he will lose the democraps. The statute of limitations on the IRS this is a ways out. He has time to address this further into his term.

    Should have called the FBI. DOJ prosecutes, FBI gathers evidence and Comey scrubbed what was provided.

    But I’ve about had it with ‘kick the can down the road.’ Some people call that game ‘run out the clock.’ There have been major crimes committed against our country, of a magnitude never before seen, and the trump administration doesn’t seem to do anything. Our founding fathers would have stood up to this. trump doesn’t have the experience, and sessions lacks the balls.
    But I still hope you are right.

However, every now and then I get to worrying that maybe Trump is a fallible human being like the rest of us, and one who has (up to now) been very much a part of the current power elite. Maybe he isn’t any longer. Maybe I think anyone in power bears watching, regardless of who they are.

    Maybe I’m just paranoid that way.

Mentally explore the results from the alternative. If I were him I would have purchased my own island and told everyone to F off. Who needs this shit? I doubt if he’s doing it for the money. So what’s his motivation?

  24. @Bad_Brad: His motivation is power. People who have achieved large sums of money turn to power as their next goal. People who have achieved power with no money seek to use that power to accumulate cash. It’s a normal human drive for those with unlimited ambition.

    Anyone with eyes has seen this all throughout history.

    I’m not saying that it’s bad, just that those in power bear watching.

    But again, maybe it’s just me. And everyone knows I’m paranoid.

    P.S. – On an unrelated note, did I ever tell you the story about a guy who lived to be 110 years old? It was such a remarkable achievement that the local paper sent out a reporter to interview him. The reporter told the guy that all the paper’s readers wanted to know the secret to living such a long life.

    “The IRS did mishandle tea party and conservative groups’ nonprofit applications, but their behavior didn’t break any laws, the Justice Department said in a letter to Congress Friday that cleared the tax agency and former senior executive Lois G. Lerner of any crimes.

    “Ineffective management is not a crime,” Assistant Attorney General Peter J. Kadzik said in a letter to the House Ways and Means Committee. “The Department of Justice’s exhaustive probe revealed no evidence that would support a criminal prosecution. What occurred is disquieting and may necessitate corrective action — but it does not warrant criminal prosecution.””

    Not surprisingly, Kadzik was a contributor to Obama’s campaign.

    In July, 2016, Judicial Watch reported:

    “Judicial Watch today released 294 pages of new Federal Bureau of Investigation (FBI) “302” documents revealing that top Washington IRS officials, including Lois Lerner and Holly Paz, knew that the agency was specifically targeting “Tea Party” and other conservative organizations two full years before disclosing it to Congress and the public. An FBI 302 document contains detailed narratives of FBI agent investigations. The Obama Justice Department and FBI investigations into the Obama IRS scandal resulted in no criminal charges.”

    And: ““These new smoking-gun documents show Obama FBI and Justice Department had plenty of evidence suggesting illegal targeting, perjury, and obstruction of justice,” said Judicial Watch President Tom Fitton. “Both the FBI and Justice Department collaborated with the Lois Lerner and the IRS to try to prosecute and jail Barack Obama’s political opponents. These FBI documents show the resulting compromised investigation looked the other way when it came to Obama’s IRS criminality.””

    We all know that the criminal behind the IRS targeting crime was Obama. It all started because of the Citizens United case and his use of the IRS to target, harass and convict (where possible) his political enemies.

    There can be only a couple possible reasons Trump’s DoJ says it is not pursuing justice on behalf of the American people. No excuse is reasonable. This is the most blatant, chilling and naked use of weaponizing the power of the federal government against innocent and defenseless Americans for the purpose of shutting down political dissent. It is directly tied to the 2012 Presidential election. If these 501(c)3 and 4 organizations — tea party and vote fraud investigators — had been able to operate without the hindrances of the IRS, it is very likely obama would have lost his second term or at least been vigorously taken to task over his ruinous policy decisions. Instead he silenced dissent and ran the country as a dictator would, without noticeable criticism.

    This cannot stand.

    Also unnoticed by the majority of the public if the _fact_ that lerner and others conducted their business while using non .gov email accounts. ala clinton. That fact alone is a good way to bring attention to the matter. While most couldn’t be bothered with the suppression of opposing political groups, they get roused when email is involved. Sad.
    This sure ain’t my idea of making something great again. Or winning.

  30. There was a time when Americans believed in freedom.

    The US is dying from a million cuts. Part of the reason the USA is a nanny police state now is that whenever there is a problem, the kneejerk reaction in the US is to call for a new law.

    Nanny state laws are not the best solution, however. Nanny state laws lead to more laws, higher fines, and tougher sentences. Thirty-five years ago, DWI laws were enacted that led to DWI checkpoints and lower DWI levels. Seatbelt laws led to backseat seatbelt laws, childseat laws, and pet seatbelt laws. Car liability insurance laws led to health insurance laws and gun liability laws. Smoking laws that banned smoking in buildings led to laws against smoking in parks and then bans against smoking in entire cities. Sex offender registration laws led to sex offender restriction laws and violent offender registration laws.

    Nanny state laws don’t make us safer, either. Nanny state laws lead people to be careless since they don’t need to have personal responsibility anymore. People don’t need to be careful crossing the street now because drunk-driving has been outlawed and driving while using a mobile phone is illegal. People don’t investigate companies or carry out due diligence because businesses must have business licenses now.

    The main point of nanny state laws is not safety. The main purposes of more laws are control and revenue generation for the state.

    Another reason laws are enacted is because corporations give donations to lawmakers to stifle competition or increase sales.

    Many laws are contradictory, too. Some laws say watering lawns is required, while other laws say watering lawns is illegal.

    Many nanny state laws that aim to solve a problem can be fixed by using existing laws. If assault is already illegal, why do we need a new law that outlaws hitting umpires?

    Nanny state laws are not even necessary. If everything was legal would you steal, murder, and use crack cocaine? Aren’t there other ways to solve problems besides calling the police? Couldn’t people educate or talk to people who bother them? Couldn’t people be sued for annoying behavior? Couldn’t people just move away? Even if assault was legal, wouldn’t attackers risk being killed or injured, too? Do people have consciences? Having no laws doesn’t mean actions have no consequences.

    If there is no victim, there is no crime.

    We don’t need thousands of laws when we only need 10.

    Should swimming pools be banned because they are dangerous? Hammers? Bottles? Rocks? Energy drinks? Pillows?

    Where does it end?

    If one state can have self-serve gas stations, why can’t every state have them? If sodas were legal 20 years ago, why can’t they be legal now?

    Freedom is not just a one way street. You can only have freedom for yourself if you allow others to have it.

    Control freaks might get angry when a neighbor owns three indoor cats, but what did the neighbor take from them? Why should this be illegal? Is outlawing cats something a free country should do? Doesn’t banning everything sound like the opposite of liberty?

    Instead of getting mad at people who like freedom, why don’t people realize that freedom is a two way street?

    If you allow others to paint their house purple then you can, too.

    If you allow others to own a gun then you can, too.

    If you allow others to swear then you can, too.

    If you allow others to gamble then you can, too.

    Who wants to live in a prison?

    Think. Question everything.
