PHILADELPHIA (AP) — Pennsylvania’s highest court threw out Bill Cosby’s sexual assault conviction and opened the way for his immediate release from prison Wednesday in a stunning reversal of fortune for the comedian once known as “America’s Dad,” ruling that the prosecutor who brought the case was bound by his predecessor’s agreement not to charge Cosby.

Cosby, 83, has served more than two years of a three- to 10-year sentence after being found guilty of drugging and violating Temple University sports administrator Andrea Constand at his suburban Philadelphia home in 2004. He was the first celebrity tried and convicted in the #MeToo era.

The former “Cosby Show” star was arrested in 2015, when a district attorney armed with newly unsealed evidence — the comic’s damaging deposition testimony in a lawsuit brought by Constand — brought charges against him days before the 12-year statute of limitations ran out.

But the Pennsylvania Supreme Court said that District Attorney Kevin Steele, who made the decision to arrest Cosby, was obligated to stand by his predecessor’s promise not to charge Cosby. There was no evidence that promise was ever put in writing.

Justice David Wecht, writing for a split court, said Cosby had relied on the former district attorney’s decision not to charge him when the comedian gave his potentially incriminating testimony in the Constand’s civil case.

  1. Guilty or not, nobody should be sentenced to prison for something that happened 30 years ago, allegedly, with no DNA evidence and just on the say-so of some #metoo idiot.

  2. Cheryl, he wasn’t sentenced for something that happened 30 years ago, he was sentenced for drugging and raping a woman in 2004.

    How the f*ck does a supreme court vacate a conviction and state that the defendant CANNOT BE RETRIED, not that the victim would want to go through this sh*t all over again.

  3. These are my thoughts as a woman – the victim was not that attractive (she looks like a dyke) and Bill Cosby was married to a smoking hot woman. Why would he feel compelled to drug and rape the victim. As to the parties in the 1970’s, both my sister and I thought “If you are a woman invited to a party at the Playboy Mansion in Los Angeles, then you must be extra vigilant to ensure your drink is not tampered.”

  4. Supposedly Cosby cut a deal at civil trial and the new prosecutor negated the deal and prosecuted him anyway.

    State Supreme court said the deal stands, even though verbal and no record of it.

  6. Cosby seems to be an egotistical jerk but, glad he was released, because he may have been railroaded.

    Wouldn’t doubt Cosby had multiple adulterous encounters over many years, but they were probably all consensual. So he didn’t have to force any of the woman to have sex with him.

    Also, the chicks he hooked up with were/are possibly frequent drug users – pills, etc. Cosby simply used that to his advantage, since most drug users will do, whatever.

  9. What about satute of limitations? Should have been a major factor before Cosby’s conviction. If it did apply, in most cases 15yrs. is usually the limit for rape. Guess it depends on the state where the crime is committed.

    His accusers with incidences from 15 yrs and beyond should never been allowed to testify at his trail.
    I read he was charged days before the statute of limitations for this particular case expired. Sounds like Cosby was set up by the left to pacify #MeToo.

    His words as best as I can recall were, “Very masculine. Not a good looking woman at all. Who the hell would want to touch her”
