Dershowitz Sees Firsthand the Bias, Bullying, and Inaccurate Reporting in Trump’s NYC Courtroom

I have observed and participated in trials throughout the world. I have seen justice and injustice in China, Russia, Ukraine, England, France, Italy, Israel, as well as in nearly 40 of our 50 states.

But in my 60 years as a lawyer and law professor, I have never seen a spectacle such as the one I observed sitting in the front row of the courthouse yesterday.

The judge in Donald Trump’s trial was an absolute tyrant, though he appeared to the jury to be a benevolent despot. He seemed automatically to be ruling against the defendant at every turn.

Many experienced lawyers raised their eyebrows when the judge excluded obviously relevant evidence when offered by the defense, while including irrelevant evidence offered by the prosecution.

But when the defense’s only substantive witness, the experienced attorney Robert Costello, raised his eyebrows at one of New York Supreme Court Justice Juan Merchan’s rulings, the court went berserk.

Losing his cool and showing his thin skin, the judge cleared the courtroom of everyone including the media.

For some reason, I was allowed to stay, and I observed one of the most remarkable wrong-headed biases I have ever seen. The judge actually threatened to strike all of Costello’s testimony if he raised his eyebrows again.

  1. Merchant and Bragg do not care about the ultimate outcome of this trial except to get a short-term Trump conviction by hook or by crook. Any conviction will be overturned on appeal, and Merchant committed reversible error from the beginning with he allowed an indictment without a clearly defined essential element, which is “what crime did Trump intend to commit when he allegedly made fraudulent entries in his books” and including whether or not the state of New York can even prosecute alleged federal election/campaign violations. This unethical conduct continued when Merchant allowed Daniels to testify to irrelevant sexual acts, and up to and including prohibiting Costello’s witness testimony by disallowing testimony that Cohen, already an admitted perjurer and Bragg’s key witness, had previously told Costello he had nothing.

    This was a local trial that has national consequences, and should have been televised so everyone could see what was going on. But it wasn’t because Merchant and Bragg wanted to rely on the media – which has very little credibility to start with – to slant the reporting of the proceedings to the public. But even MSNBC and CNN were forced to admit on several occasions that Bragg’s case was not going well.

    But a Trump conviction that will ultimately hold up is not the point; the purpose is to try to get a conviction in the here and now that will harm Trump’s election chances thereby making a later successful appeal worthless except to clear Trump’s name. Personally, I don’t think a conviction will happen, and that a hung jury seems more likely.

    The underlying motives of this prosecution seem clear – harm Trump’s election efforts. This is such a wrongful and egregious proceeding brought for purely political reasons that Merchant and Bragg should be disbarred.

  2. Judge Pirro pn Fox yesterday was going absolutely ballistic about Merchan’s antics. He was not chosen randomly out of a pool of judges. He was hand picked by Alvin Bragg because he was the most vicious partisan in New York. His jury instructions will be to pick a crime; any crime will do. There is 100% chance he will be found guilty and sentenced to jail. The haters will wet themselves with glee because they know there’s not a thing anybody can do about it. We can get angry, turn out in record numbers to vote, it matters little. With rigged voting machines and millions of mail in ballots sent to illegals the election is a mere formality. We are staring at the prospect of Obamas 4th term.

  3. The bigger picture is a function of The Party working tirelessly to keep the masses so focused on the individual trees that they are not able to step back and comprehend what is happening to the forest as a whole.

    I keep going back to this because it is so concise, yet comprehensive in what this bold faced contempt for the law is all about.

    When DNs are confident that they have enough power, be it over a small group of people (family members, co-workers, social circle, cult), or on a macro scale, such as in a government, large corporation, or The Church, they will become progressively more bold and VISIBLE in their crimes in order to generate ever-higher amounts of diabolical narcissistic satisfaction.

    Now here is where it gets interesting. For DNs, the commission of their crimes and malefactions themselves are NOT the most potent source of diabolical satisfaction. No – the real rush, the “high” that they crave more than anything is THE GETTING AWAY WITH IT. Specifically, DNs luxuriate in watching other people, whether it be out of fear or sycophancy, pretend to not see, or better yet lie to cover, or even better yet, positively defend and justify, their crimes.

    Having planned and fantasized about his malevolent actions, the DN will watch and study those around him in the aftermath. Every instance of “looking the other way” the DN sees gives him an even more intense rush, because to look away from his crimes is to capitulate and submit to him – an even more complete capitulation than the actual victim. Every lie that a sycophant tells to cover for the DN is a rush. Every groveling justification made on the DNs behalf for the DNs unjustifiable, or even criminal behavior, is like the rush of a drug – and far more psycho-spiritually potent than the initial act itself.

    What Ann leaves out is that for the masses to see this go down in real time and feel powerless to do anything about it is demoralizing and leads from frustration to an increasing sense of powerlessness. Now, this is where those who still believe that the Republicans are against this. Trust me on this, the Republican establishment is playing their scripted and choreographed part in this wicked and evil production. Their feigned opposition is absolutely right out of their tattered, dog eared and worn script that they have been reciting their lines from for decades. It’s so recognizable that before each scene in which the Republicans are going to haul the guilty before a Committee that everyone in the audience who has been paying attention knows that at best the outcome will be yet another “strongly worded letter.” In other words, nothing will come of crimes that amount to an attack on our Constitution if not outright treason. Which, in case you don’t know, warrant severe public punishment up to including death.

    Just the fact that any and all of their dear, dear friends across the aisle, irrespective of if they are Democrat or Republican become filthy rich on insider trading deals and there is absolutely no opposition from either side should tell you that they are both in on it, and their number one priority is protecting that racket and others.

    But I diverge. The bold faced contempt for law, the politicization of the law and the the usurpation of the DOJ, FBI, CIA etc for political purposes by the Democrats and the Republicans playing their scripted and choreographed part by feigning outrage and harumph, harumph, harumph

    “Economy in shambles! Nuclear threats! We have to protect our phoney baloney jobs here, gentlemen! We must do something about this immediately!”

    Yea, We’ve gotta protect our phony baloney jobs!

    In other words, we have to bamboozle the public into thinking we give a flying fuck and put on like we mean it or they might derail the Gravy Train that serves us as well as our dear, dear friends across the aisle.

    It’s obvious what is going on in the forest to anyone who instead of being focused on one individual tree (current thing) after another and steps back and looks at all of the forest (all of the individual trees in context).

  4. The rule of law is dead. I have heard there are two lawyers (ringers) on the jury; they will explain to the jury why President Trump is guilty and he will be convicted.

    I no longer have any faith in our governmental institutions; I’ll rely on Christ Jesus. Everything will work out in the end.
