GBI says it was not consulted by DA before charges filed against officers in Rayshard Brooks case

11Alive: The GBI said it was neither made aware of the press conference before it happened, nor was it “consulted on the charges filed” by the District Attorney’s office.

ATLANTA — The state agency responsible for conducting an independent investigation of the death of a Black Atlanta man during an encounter with white police officers in the parking lot of an Atlanta fast food restaurant said it was surprised by the announcement that those officers would face charges.

On Wednesday, Fulton County District Attorney Paul Howard announced that fired Atlanta Police officer Garrett Rolfe would be charged with murder and 10 other counts following the fatal shooting of Rayshard Brooks Friday. Rolfe’s partner, Devin Brosnan, also faces three charges in connection to the shooting.

It’s an announcement that the Georgia Bureau of Investigation said caught the agency off guard. In a statement posted moments after the charges were announced, the GBI said it was neither made aware of the press conference before it happened, nor was it “consulted on the charges filed” by the District Attorney’s office.

In the case of most officer-involved shootings in Georgia, the state agency must be requested by a local police department in order for the GBI to open an investigation into what happened. That is what happened in Friday’s fatal shooting, when the Atlanta Police Department called for the GBI’s assistance.  more here

  4. Black Colored People are upset that their version of events doesn’t look the same to other people reviewing the same evidence. Rayshard Brooks wasn’t facing years in prison for being a bit intoxicated, he was on parole after being sent away for numerous felonies and was headed back to prison to complete his sentence. The arresting police officers probably knew his criminal record before one of them approached his vehicle. This wasn’t a fender bender. Rayshard was passed out in the drive through and had to be awakened three times before he could be given his roadside tests. He sobered up enough to realize this and started a fight with two police officers. Then other things happened. When these officers get off these trumped up charges, Atlanta’s residents can prove once again how much Black Colored Lives Matter. I’m putting my money on more rioting and looting. It’s a Black Colored People response to everything involving law enforcement.

  5. the DA in this case is a dumbass. He jumped the gun and filed charges, likely looking to get a name for himself so he could seek higher office. But it has backfired on him – now people are digging into his background and finding gross hypocrisy regarding the Taser lethality issues, the DA’s corruption and financial incompetence. I’m sure more will come out by tomorrow.

    Next thing you know they’ll uncover he is a member of the Sons Of Confederate Veterans.

This sort of D.A. is a main point we always try to make when teaching a concealed carry class, if you’re going to carry a firearm be prepared to deal with a liberal grandstanding DA who is out to make an example of anyone that tries to protect them self in the event of a shooting incident. The way they see it right or wrong…you’re wrong!

  7. This announcement is interesting since when DA Howard had his press conference yesterday, he specifically said his office worked with the GBI on what charges to file. Somebody is lying and it isn’t the GBI.

  8. The Jury pools are all tainted from the sensationalized news reporting and the accused officers will never be able to get a fair trial because of it.

    In the interest of justice, Trump should give these officers and all other officers accused of something similar since the BLM violence started, a full pardon.

    That’s the only way to restore peace and justice to our nation and put this stuff behind us.

  9. The big tell…. twice, during the presser, Howard called for judicial reform….doing away with implied immunity for LE, AND bypass grand juries. He explicitly said due to court backlogs (COVID), this case wouldn’t be heard until Jan. We need to change the laws so the DA can indict, and if it were up to him he would indict.

    Think of that.

    I thought that’s what Howard did, indicted, convicted and sentenced Rolfe all within 45 min

  10. If this case did not involve police officers and the inflamed feelings of many people today, the DA’s hasty actions, sidestepping the GBI, and his public statements would merit dismissal of charges for prosecutorial misconduct. I am not a lawyer, but I have watched a lot of lawyer TV.
