Judge Nap Says 9th Circus Ruling Only A Temporary Victory of Sanctuary Cities

 

Appearing on Fox and Friends this morning, Judge Andrew Napolitano declared that the ruling allowing sanctuary cities to continue receiving federal money from the Department of Justice is only a temporary reprieve.

All that’s needed is for congress to put language in the next annual funding bill (in October) requiring recipients comply with federal immigration law and the withholding of money will be perfectly legal.

  1. Counter argument to the Judge:

    Reference: Article II, Section 3, clause 5 of the US Constitution, and, U.S. Code title 8 Chapter 12, Subchapter II, Part IX 1373 “Communication between Government Agencies and the Immigration and Naturalization Service” signed into law by President Clinton.

    Also, See Title 8, US Code 1324(a) Offenses. Harboring — Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who — knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation.

    The decision by the federal judge excludes any reference to the enforcement of existing law as listed in the Executive Order.

    Plus, just to refresh your memory, President Obama “hinted” to impose a similar sanction of federal grand funds if cities failed to incorporate his “policy” on transgender bathrooms.

    I support Helo Driver’s enforcement of existing law regarding harboring unauthorized aliens.

  3. @Helo – yes, I think criminal charges would be more effective, and well within the law that Clinton signed.
    Remember when all the libs wanted to jail the Kentucky woman who refused to sign gay marriage licenses. Time to invoke the same standard.

  4. I wish Trump would stop making nice with the establishment judges and congress. He should just unleash and let them have it. Wage war against the left. Winning leads to more winning. Letting judges stop or delay you looks like losing. Do whatever you have to do to get the job done, now, to push your mandate forward.
