GP: Daniel Penny was found not guilty of criminally negligent homicide in the death of Jordan Neely during an incident on a New York City subway in 2023.​

The jury reached this verdict after more than 24 hours of deliberation across five days.

Penny had pleaded not guilty to charges of second-degree manslaughter and criminally negligent homicide, following an altercation in which he placed Neely in a chokehold. more here

  4. Although good news, there are some scary takeaways from this. Ignoring the obvious: He should never have been charged, and after 4 days the jury needed help from the judge on what “reasonable” and “prudent” means. And they still came back deadlocked on the original charge, which means that either one to eleven jurors wanted a conviction. This dumbass jury came precariously close to sending this hero to prison. It should never come down to this.

    Some of the most monumental landmark decisions by SCOTUS have come down five to four, District of Columbia vs. Heller, for instance. The obvious interpretation of the 2nd Amendment, declaring once and for all that citizens have a basic right to own a gun, this was codified under the slimmest of margins.

    And yes, it is good that SCOTUS is at present considered a conservative leaning body, they can’t decide everything, and hundreds of radical activists posing as judges have been put in place by Biden to waylay proper justice midstream.

  10. Mr. Penny should sue Jordan Neely family for letting him run loose when they new he was a threat to people. Same for the judicial system for letting him run free.

  11. When Neely’s family gets into the court room the question needs to be asked “You knew you had an extremely mentally disturbed son. Why didn’t you take care of him or get him the proper help instead of kicking him to the curb with his death being the end result?” Case over.

    In the long run they did accomplish what they were after. who in their right mind would step in and try and save someone or someones after what this guys been though? If you were armed or not. It’s not worth it.
    I’ve typed this story before here, but the guy I go to for my CCW classes is recently retired Sac county Sheriff. He a post certified trainer. He’s been involved in three shoots himself. Twenty years ago he laid out a scenario where you’re standing in line at your local grocery store and some guy sticks a gun in the tellers face and demands all of her money. What do you do? His answer. Not a damn thing. It’s not worth it. If you just pull your gun odds are someones going to sue you. If you discharge that weapon you’re definitely getting sued and maybe prosecuted. My guns on my hip for one reason only. To protect myself and my family members. They will drive you broke in legal fees. That’s why I keep saying it going to take more that just Nation Wide Reciprocity to get people that carry actively helping curb violence. We need some sort of shelter from these anti gun groups and the fear of prosecution by some clown like Alvin Brag.

  15. Brad, I agree with you totally, on a risk/reward analysis, it is not worth it. But here’s the problem, Many men are hard-wired to react and do something when they can. A couple thousand years of biology have conditioned men to “run towards the guns”, to intervene because, well, that’s what men do. Most cops, steeped in an understanding of liability, will probably do the safe thing and retreat. But your ex-military guy (like Penny) lives by a certain ethos where men protect and defend, and it is really hard to shut down that instinct during the split second when he needs to act.

    In the old days, and I can attest to this personally, your average citizen would step up and protect the weak from an aggressor, today, sadly, there is no good compelling reason to intervene, and that really sucks.

Ns don’t give a shit about their kids until they die in some high profile way that can be connected to a white person, and then it’s off to civil court for a try at the hate-whitey wheel of misfortune.   21. No actually he should go for the big money and sue NYC. Mayor Adams has already said publicly that Penny did the job NYC should have. That sound pretty open and shut and big dollars to me.

    Also slightly OT, it seems DJT is finally on to the NRA. They’ve discover a couple NRA lawyers that make big bucks off the organization have a bad habit of donating lots of money to libtards. So don’t be surprised when you hear the NRA bad mouth Trump.

  24. Very good news! Praying Mr. Penny gets the recognition he deserves as a hero who saved lives.
    Hopefully, the grifting Neely clan, especially the lunatic dead perp’s depraved “father” get what they deserve…nothing in the civil suit against Penny.
