Harvard Law School professor Laurence Tribe claimed there is a chance that neither Joe Biden nor Donald Trump will be president for the next four years.
Tribe, who is a vocal critic of President Trump, argued on Friday’s edition of The ReidOut that if the winner of the election is not determined by Jan. 20, 2021, House Speaker Nancy Pelosi, the third in line for the presidency, would assume the office.
“They’re trying to make it look chaotic, but there is a fail-safe mechanism built into the Constitution itself. And that is no matter how much dust [Trump] throws into the gears, at high noon on Jan. 20, 2021, if there has not been a new president elected, at that point, Nancy Pelosi, speaker of the House, becomes president of the United States,” he said on MSNBC. With mail in voting, if Trump is ahead on election night, they’ll still keep counting mail in votes until the democrats can find enough. Then when they’ve manufactured enough mail in votes to push democrats ahead, they’ll declare the voting needs to stop.

Mark Levine addressed this last night. If there is no winner, then the House decides, and each state gets one delegate. The republicans would have 26 votes. The democrats would have 22 votes. Two states could vote either way.

I thought there was a law/whatever that says the electors have to be enabled by 30 days after the election. Wasn’t that one of the reasons the supreme court stopped the vote counting in Florida when Bush was elected? So it can’t go until 1/20/21, can it?

but, the VP serves the same term as POTUS …. sooooooooo, technically POTUS’ term has ‘expired’, not ‘died’, ‘removed’ or ‘resigned’

Conflating the 25th Amendment with the 20th Amendment.
What happens when no President nor Vice President has been qualified by the electoral college by Jan 20, is that the House of Representatives votes on who the President will be and the Senate votes on who the Vice President will be. So it basically works the same as if the Electoral College ended in a tie. It does not work like both the President and VP died. Of course, throwing the selection of the President to the current House is scary enough.
Section Three of 20th Amendment: “……and the Congress may by law provide for the case wherein neither a President elect nor a Vice President shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.”
Section four of the 20th Amendment: “The Congress may by law provide for the case of the death of any of the persons from whom the House of Representatives may choose a President whenever the right of choice shall have devolved upon them, and for the case of the death of any of the persons from whom the Senate may choose a Vice President whenever the right of choice shall have devolved upon them.”
