Oh, So Close – IOTW Report

Oh, So Close

It’s sad but true, after this last election Republicans are one state house short of controlling over the 2/3rds needed to call a Constitutional Convention.

So how would you Amend the Constitution?

  1. How would I amend the Constitution? I’d focus on a few items that have been horrible abused, misinterpreted, or included deliberately to allow for the metastasizing of central govt.

First, in the Preamble, get rid of the “promote the general welfare” clause. Second, rework Article III to specifically state exactly how constitutional review is to be performed by some body other than the SCOTUS. Third, in Article I Section 8, remove items 1, 2, 3, 5, 6, 7, 8, 17, and 18.

    That’s for starters.

  2. First, I’d repeal the 17th Amendment and return appointment of all Senators to their respective State legislatures–the original concept was for the States to have their own house in the Federal legislature.
Second, I’d rework the 14th Amendment to restore States’ rights.
We’ve gotten far afield from the original concept of Federalism and I fear that this is the sad legacy of Lincoln and his successor Johnson with the Reconstruction Amendments.
But then again, I also believe that the individual States still retain their right to secede from the Union, just like the US can no longer belong to the UN.
I know, call me a dinosaur.

  3. 1. Repeal 16th and 17th Amendments.

    2. New Ammendment: No hidden taxes. All taxes collected from the citizens must be paid directly by each citizen in the form of a check written to the US Treasury c/o (fill in Presidents name), (fill in senators names), & (fill in representatives name). All taxes.

    3. New Amendment: The commerce clause ONLY gives the federal government the power to eliminate barriers to interstate commerce. All current federal laws and regulations that were justified under the commerce clause are null and void except those that only remove barriers to interstate commerce and nothing else. All departments of the federal government that exercise powers that were not specifically enumerated in the Constitution will be immediately closed and all staff of said departments employment shall be immediately terminated.

  4. Make it unconstitutional to be forced to buy insurance. If you want to die without it, it should be your right.

Make all executive orders expire on the day you leave office.

Laws must be promulgated thru congress.

  5. New Amendment: The central bank of the United States (the Federal Reserve) shall become fully and solely the property of the federal government. None of the current “owners” of the Federal Reserve shall be compensated for this forfeiture of property. All transaction fees earned by the Federal Reserve since its creation shall be paid back to the United States Treasury in full with interest. The central bank of the United States shall be fully audited at least annual and full results of said audit shall be made available to every citizen.

  6. I know Graham Ledger at OANN is always promoting such a convention.
I’d be afraid now that elimination of the EC would be introduced. Don’t call me m’am Boxer and Charlie Rangel have introduced such bills (showing their ignorance to the fact that it would require a constitutional amendment, not a congressional bill).

  7. Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Senators, Representatives of Congress and the President of the United States; and, Congress shall make no law that applies to the Senators and/or Representatives and the President of the United States that does not apply equally to the citizens of the United States.

  8. I’d dump the income tax and go back to financing the gubmint with excise taxes (eliminate the 16th Amendment). And I’d have Congress regulate the currency (Art I, Sec 8) instead of the FedReserve like it used to be by repealing the Federal Reserve Act of 1913. Then dig up the bones of everyone who voted for it and bitch slap them.

  9. Great stuff here. I’d like the 2nd changed to very specifically gurantee the individual (citizen’s) right to bear arms.

Ditto above on repealing the 16th and 17th, strengthen the tenth with specific control on things like abortion and education.

And, in a perfect world, exclude islam from the first amendment

  10. So I would submit that candidates and elected politicians be subject to minimum standards such as a basic competency test as well as a background check. Let’s face it, there are too many politicians out there today feeding at the public trough who simply couldn’t cut it in the Private sector due to lack of talent, lack of morals, criminal backgrounds or all of the above. We have elected officials who aren’t even “Entry Level” material who are worried that Guam may capsize or think we went to Mars in 1969! Is it too much to demand that the people who govern us have better mental agility than small soap dish and higher morals than a dog in heat for cryin out loud???

  11. Dingo nailed it. Danger of 21st century politicians going after a 200 year old document.
Imagine what they would do with the second amendment. The liberals are always saying it didn’t apply to individual gun ownership (only to militia) and surely couldn’t have meant semiautomatic weapons.

  12. Dingo Brown “Be careful what you wish for. They could also scrap the constitution & start over. Midnight meetings & all.”

Correct Too many rinos in town. Bury all the rinos first and then we’ll talk.

  13. I can’t think of anything more risky to our Republic than a constitutional convention. They could literally do whatever they wanted to including throwing any or all of the old constitution and creating a new constitution. Would you seriously trust the kinds of people who would get appointed to a constitutional convention to have your and our country’s best interest at heart?

  14. “I hold it that a little rebellion now and then is a good thing, and as necessary in the political world as storms in the physical.” – Thomas Jefferson

We can’t follow the one we have and our government is out of control. Who will stop us? So far, we haven’t.

  15. An Article 5 Convention of the States DOES NOT open up the constitution carte blanche for them to screw with:

    U.S. Constitution – Article 5

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

  16. @Dingo Brown: Interestingly enough, Thomas Jefferson thought the Constitution should be rewritten (or at least heavily revised) every 19 years, so that current generations would not be bound by laws which were made by prior generations, and which they had no part in creating. He felt that no constitution or law can be perpetual, that every constitution and law requires periodic re-ratification to remain effective. To do otherwise, he reasoned, would result in living people being governed by those no longer alive.

  17. As stated above by pbunyan repeal 16th and 17th amendments.

Plus new amendment: except for military academies and that which is needed for national security, the federal government shall not fund, direct, dictate nor impose any public educational curriculum or requirements upon the states, all decisions and funding regarding public education shall remain with the states and local governments

  18. 1) No cash transfers between units of government (Fed->State->Local, etc);

    2) No payments out of fed treasury except for goods or services at market value.

    3) Executive branch may not direct proceeds from litigation, fines, or user fees; all revenue goes directly to fed treasury;

  19. Shore up the 2nd with clearer language for the shitlibs, explain in the 1st that the press can be fed to alligators if they lie, shore up the 10th, ditch the 16th, 17th, and, as a woman who understands I’m in the minority of correct voters, REPEAL THE 19th.
Also, make new amendment requiring all institutions of learning are demolished & we take a Marxist break for 5-10 yrs, before starting over.
    Also, nuke coastal cities.

  20. No more of that 4 or 12 topics per bill to be voted on. One item per each bill proposed. No, I’ll put in this if you give him that and I’ll vote for this if you vote for that, and then you give her that. Fuck all that!
One problem, one bill for that problem.
You work 8 months, you go home for 4 and get a fucking job. If it’s an emergency, we’ll call ya. Until then, wait by the fucking phone.

  21. Zeroh Tollrants
“Also, make new amendment requiring all institutions of learning are demolished & we take a Marxist break for 5-10 yrs, before starting over.

    Love it!

  22. Define marriage by the biological and moral absolutes established since forever and state that no lawyers with lifetime judicial positions can ever come up with something as idiotic as claiming two queers hooking up is marriage.

  23. The us Gov’t cannot enter into operational deficit. Budgeting must be revenue neutral.
Taxes cannot be levied on labor.
The Treasury cannot issue payments to any entity if the US Gov’t has a deficit, except in times of declared war.
Debts occurred during times of declared war must be entered into with a timeline for repayment.
Not other debt shall be constructed outside a time of declared war, and only for the purpose of defending the citizenry during that time.
